Terms of Use

Last updated: November 3, 2026

1. Acceptance

These Terms of Use govern your use of buildsandiego.com and any forms, store, donation pages and services offered through it (the "Site"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. About us

The Site is operated by Build San Diego Foundation ("BSDF," "we," "us"), a California nonprofit public benefit corporation recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, EIN 20-1800690, 10140 Riverford Road, Lakeside, CA 92040.

3. Use of the Site

You agree to use the Site only for lawful purposes and to provide accurate, current information when you submit a form, register, purchase or give. You may not interfere with the Site's operation, attempt unauthorized access, submit harmful code, or use the Site to send unsolicited messages.

4. Donations

Contributions are processed by our payment partner, Givebutter, and are subject to its terms. Contributions are voluntary and, once received, are used at BSDF's discretion in furtherance of its charitable mission. Where a donor designates a program or fund, BSDF will honor that preference where practicable and reserves the right to redirect funds to similar purposes when a designated program is fully funded or no longer operating. Contributions are generally non-refundable. If you believe a gift was made in error, contact us within 30 days and we will review the request in good faith.

Contributions are tax-deductible to the extent allowed by law. Where goods or services are provided in exchange for a contribution, such as event admission, the deductible amount is limited to the contribution in excess of their fair market value, which BSDF will disclose at the time of the gift and on your receipt. BSDF does not provide tax, legal or accounting advice. Please consult your tax or financial advisor about your specific situation.

5. Builders Guild

Builders Guild membership is a recognition program for annual donors. Recognition is offered as an acknowledgment of your gift and has no fair market value. BSDF may update program levels, names and recognition at any time. Members may request to be listed anonymously.

6. Build San Diego Talent Network (job seekers)

The Talent Network is a free service that helps connect job seekers with employers and training opportunities. BSDF is not an employment agency, staffing firm or employer of record, and does not guarantee interviews, offers or employment. By submitting your information, you authorize BSDF to share your profile and resume with employers and training partners as described in our Privacy Policy, and you confirm the information you provide is accurate. You may ask us to remove your profile at any time.

7. Hiring Partners (employers)

Employers who register agree to use candidate information only to consider candidates for lawful employment or training, to keep it confidential, and not to resell or redistribute it. Employers are solely responsible for their hiring decisions and for compliance with all employment, anti-discrimination, wage and background-check laws. BSDF does not screen, endorse or guarantee any candidate. Employers who provide a logo or company name grant BSDF a limited, non-exclusive license to display it on the Site and in BSDF materials, and may withdraw it at any time.

8. Store purchases and event registrations

Prices, availability and event details may change. Hiring Fair listings, sponsorships and registrations are confirmed upon payment. Unless stated otherwise at purchase, fees are non-refundable, but may be transferred to a substitute attendee or a future event with notice. If BSDF cancels an event, we will offer a refund or a credit toward a future event.

9. Events, workshops and media

Participation in BSDF events and workshops is voluntary and at your own risk, and you agree to follow posted safety instructions. BSDF may photograph or record events and use those images to promote its mission. If you prefer not to be photographed, please tell a staff member. Images of minors are used only with consent from the school, program or a parent or guardian.

10. Minors

The Site is intended for adults. Students under 18 may use the Site with the involvement of a parent, guardian or educator. We do not knowingly collect personal information online from children under 13.

11. Intellectual property

The Site's content, including text, images, logos and the marks Building Tomorrow, Workforce Bridge Scholarship and Build Together, are owned by or licensed to BSDF, under trademarks pending or fully registered, and may not be copied or used commercially without written permission. You may share links and brief excerpts with attribution.

12. Third-party services and links

14. Limitation of liability

To the fullest extent permitted by law, BSDF and its directors, officers, staff, volunteers and partners are not liable for any indirect, incidental or consequential damages arising from your use of the Site or services. Our total liability for any claim is limited to the amount you paid BSDF, if any, in the twelve months before the claim.

15. Indemnification

You agree to defend and hold harmless BSDF and its directors, officers, staff and volunteers from claims arising from your misuse of the Site, your violation of these Terms, or, for employers, your hiring practices.
